Limitations of action
All claims for compensation must be determined by a board, and that any legal action for compensation is not allowed. This document also replaces all other legal claims that a worker, their representative, or their dependents might have against the employer or another worker for a work-related injury. However, there are exceptions, such as when the injury results from the use of a vehicle.
If there is a legal dispute about whether a cause of action is removed by this document, any party to the dispute can ask the board to make a determination, and the board must provide written reasons. If a party disagrees with the board's decision, they can appeal it in writing to an appeal tribunal.
Only the board can commence a proceeding in relation to an offence under the Worker’s Safety and Compensation Act.
Time limit
Prosecution for an offence must be started within two years of the last act or omission that the prosecution is based on.
