Who Can Make a Will

A person may make a valid will if, at the time the will is made, the person:

  • is 19 years of age or older

    • unless:

      • the person is a member of the regular force (army)

      • is a member of another component of the Canadian Forces and is, at the time of the making of the will,

      • is a member of the Royal Canadian Mounted Police

      • is a mariner at sea or in the course of a voyage; and

      • the person must still have the capacity to make a will

  • has the mental capacity to make a will.
