Requirements of a Will

A will must be:

  • in writing,

  • signed by the testator or someone authorized to sign on their behalf, and

  • witnessed by at least two people, and

    • those witnesses must attest and subscribe to the will in the presence of the testator.

A holograph will is entirely in the handwriting of the testator and signed by them, and can be validly made without any witness requirements.

If the signature is not at the end of the will, as long as it appears that the testator intended to give effect to the writing signed as their will, the will is valid.
