Subletting/Assignment
A tenant cannot assign or sublet their rental unit to someone else without the written consent of the landlord. This means that the tenant cannot simply transfer their lease or rent out their unit to another person without obtaining permission from the landlord first.
The landlord cannot unreasonably withhold their consent to the transfer or subletting of the unit.
The landlord cannot charge the tenant any fees for considering, investigating or consenting to the transfer or subletting of the unit.
If the landlord agrees to the transfer or subletting, the tenant must provide notice to the landlord of the request for consent at least one month before the transfer or subletting takes effect.
The notice must also be given at a specific time before the rent is due, which is usually the day before the day in the month or other period on which the tenancy is based that rent is payable under the tenancy agreement.
This notice requirement can be waived if the landlord and tenant come to an agreement otherwise.
