Requirements of Agreement

Landlords must prepare every tenancy agreement in writing

  • This means that landlords cannot have an oral agreement with tenants if the tenancy agreement

A Standard Lease must include certain information such as:

  • Standard terms: These are pre-set terms that are required by law to be included in every tenancy agreement. These terms cannot be changed or removed by the landlord.

  • Legal names and addresses: The agreement must include the correct legal names of both the landlord and tenant, as well as the address of the rental unit.

  • Date and contact information: The agreement must include the date the tenancy agreement was entered into, as well as the landlord's or their agent's address for service and telephone number. It must also include a telephone number that the tenant can call in case of emergencies.

  • Agreed-upon terms: The agreement must include the terms that both the landlord and tenant agreed upon regarding the start and end date of the tenancy, the amount of rent payable and when it is due, the maximum number of occupants allowed in the rental unit, and the services or facilities included in the rent.

  • Security deposit: If a security deposit is required, the agreement must state the amount of the deposit and when it was or must be paid.

Landlords are required to give tenants a copy of the signed tenancy agreement within 21 days after they enter into the agreement.
