Vacation Pay

Annual Vacations

All employees, including part-time, seasonal, or temporary basis

  • unless the employee is a member of the employer's family

Every employee is entitled to and shall be granted a vacation with vacation pay of at least two weeks in respect of every completed year of employment.

  • An employer and employee may come to an agreement to forgo vacation for a given year, where the employer shall still pay the employee their entitled vacation pay within 10 months of when the employee becomes eligible.

Vacation must be granted by the employer and must begin no later than 10 months after the completion of the year of employment for which the employee became eligible.

  • at least one day before the vacation is to begin, the employer shall pay the employee the owed vacation pay

Vacation Including general holiday

If an employee’s vacation falls on a general holiday, the vacation shall be extended an extra working day. and the employer shall pay the employee the pay that the employee is entitled to for the general holiday

End of Employment before the end of year

If the employment of an employee by an employer is terminated before the completion of the employee’s year of employment, the employer shall, within seven days from the date of termination, pay the employee:

  • any vacation pay owing by the employer in respect of any prior completed year of employment

  • 4% of the wages of the employee during the completed portion of the employee's year of employment

    • an employer is not required to pay an employee any amount under that paragraph unless the employee has been continuously employed by the employer for a period of 14 days or more.
