Sex discrimination

No employer or anyone acting on the behalf of the employer shall discriminate between male and female employees by paying either gender less than the other in rate of pay., for similar work performed in the same establishment in similar conditions; that requires similar skills, effort, and responsibility. Except when the payment is made in a:

  • seniority system

  • merit system

  • a system that measures earnings by quality or quantity of production

  • a differential based on any factor other than sex
