Hours of Work
An employee's maximum working hours are 8 hours per day and 40 hours per week.
Employers shall not cause or allow employees to work more than the standard hours of work, unless the employer:
pays overtime pay, or
provides time off in lieu of pay.
Employers must pay overtime to employees who work more than 8 hours in a day or 40 hours in a week,
at a rate of 1.5 times their regular wages, or
time off with pay instead of overtime pay,
as long as it is agreed upon in writing between the employer and employee or a collective agreement.
Normally, an employer must make reasonable efforts to give the employee advance notice. However, in an emergency situation, the employer may require the employee to work overtime on shorter notice.
An employee has the right to refuse to work overtime for just cause, but they must tell the employer in writing why they are refusing.
