Eating Periods

An employer must make sure that their employees have a break of at least half an hour to eat, and that these breaks should be given at intervals that allow for the employee to work a maximum of:

  • 5 consecutive hours before the break if they work 10 hours or less that day, or

  • 6 consecutive hours before the break if they work more than 10 hours that day.

When calculating an employee's hours worked, the time they spend on their break should not be included, unless they are required to work during that time.
