Maternity, Adoption, and Parental Leave
Maternity Leave
An employee who is pregnant is entitled to a 19-week maternity leave that can begin up to 13 weeks before the estimated due date.
If the actual birth date is later than the estimated date, the employee is still entitled to six weeks of leave after the birth.
If the employee cannot return to work due to medical reasons, the leave can be extended for an additional six weeks.
The employer must modify the employee's duties or reassign them to other duties if their pregnancy or duties unreasonably interfere with each other.
The employer may require an employee to start their maternity leave earlier if their pregnancy unreasonably interferes with their work and there are no other options.
Adoption Leave
Employees who adopt a child are entitled to a 19-week adoption leave, and both new parents are entitled to a parental leave of up to 59 or 71 weeks, depending on the situation.
Parental Leave
New parents are entitled to a parental leave of up to
59 weeks if taken with a maternity/adoption leave; or
71 weeks in other situations
The parental leave must be taken during the first 13 weeks after the estimated due date or when the child comes into the employee's care, and it must be completed within
78 weeks if one employee is taking leave; or
86 weeks if multiple employees are taking leave
