Death/Disappearance of a Child Leave

An employee may be entitled to take leave from work if their child dies or disappears as a result of a crime.

If it is probable that the child's death or disappearance is related to a crime, the employee may be able to take up to:

  • 104 weeks of leave if the child has died, or

  • 52 weeks of leave if the child has disappeared.

However, if the employee is charged with the crime or if it is probable that the child was involved in the crime, the employee is not entitled to this leave.

If the child is found alive within the 52-week period, the employee may take an additional 14 days of leave, but if the child is found dead, the employee may take up to 104 weeks of leave.

  • The employee may only take this leave within a certain period of time after the child's death or disappearance.
