Role as Executor
Every resident of the province names as executor in any will shall, within thirty days after being informed of role, cause the will to be proved and filed in the court, and either apply for letters of probate, or file a written declaration of their refusal of the executorship
Where any non-resident named executor, they shall comply within 3 months of after the death
anybody who doesn’t comply is liable to a penalty not exceeding $100 per month after the period allotted above until they comply or provide an excuse for delay
any person who conceals or suppresses any will is liable to the penalty recovered
proof of execution: the execution of any will may be proved in common forms for the purpose of filing the same and granting letters of probate, by oath or affidavit
Inventory:
When someone dies and leaves property behind, the person responsible for managing their assets (the personal representative) needs to make an inventory of all the property and estimate its value.
The representative needs to notify anyone who will benefit from the property about the probate (the legal process of distributing the property) within a month.
If the personal representative doesn't make the inventory on time, they can be required to do so by a court order. If they discover any property that wasn't included in the inventory, they have three months to add it to the inventory.
