Notice for Termination/Pay in Lieu of Notice

Unless there is just cause for termination, an employer shall not terminate an employees employment who has been employed for 6 months or longer without giving notice of:

  • 2 weeks notice, where the employee has been employed longer than 6 months and less than 5 years

  • 4 weeks’ notice, where an employee has been employed 5 years or longer and less than 10 years

  • 6 feels notice, where an employee has been employed for 10 years or more and less than 15 years; or

  • 8 weeks’ notice, where the employee has been employed for 15 years or more

Termination without notice:

An employer does not need to provide notice if:

  • A person who was hired for a specific task that is expected to last less than 12 months.

  • A person who is laid off for no more than six consecutive days.

  • A person who has been offered a reasonable alternative job by their employer.

  • A person who is laid off or terminated for reasons beyond the control of the employer, such as a natural disaster, equipment breakdown, or lack of orders for the employer's products. The employer must have tried to prevent this from happening.

  • A person who is laid off or terminated due to labour disputes, weather conditions, or actions of the government that directly affect the employer's operations.
