Critically Ill Child Leave
Entitlement
If an employee has worked for their employer for at least three months and has a critically ill child, they can ask for up to 37 weeks of unpaid leave to care for their child.
This leave must be taken within a 52-week period starting from either the day the child's medical certificate is issued or the day the employee begins their leave.
The employee's entitlement to this leave ends if the child passes away or if they have taken 37 weeks of leave within the 52-week period.
If an employee has more than one critically ill child, they can still only take a total of 37 weeks of leave within the 52-week period.
Return to Work
When the employee returns to work, the employer must give them the same position and pay as before, or a comparable position with the same pay and benefits.
Certificate
The employee must provide the employer with a copy of the medical certificate if asked for it.
