Bereavement Leave

When an employee's immediate or extended family member dies, the employer must give the employee time off from work. If the deceased person was an immediate family member, the employee gets one paid day off and up to two more days off without pay.

  • If the deceased person was an extended family member, the employee gets up to three consecutive days off without pay.

If an employee experiences a prenatal pregnancy loss or stillbirth, they are entitled to the same bereavement leave as if a member of their immediate family had died.

  • If an employer provides one paid day of leave for bereavement, they must pay the employee at their regular rate of pay for that day.

If an employee takes bereavement leave during their vacation, the employer must add one more working day to their vacation.

Employees must take the leave of absence during the period of bereavement and must start it no later than the day of the funeral or memorial service if there is any.
