Legal Action and Limitations
Workers cannot sue their employers or other parties for workplace injuries or illnesses that are covered by the insurance plan. Instead, all claims for benefits must be heard and determined by the Board.
Entitlement to benefits under the insurance plan is in lieu of all rights of action that a worker, their spouse, child, or dependant may have against their employer or an executive officer of the employer for an accident or occupational disease that occurred during their employment.
