Who can make a Will

An individual who is 18 years old or older shall make a will.

If someone is under 18 years old, they cannot make a valid will unless:

  • they are married,

  • planning to get married and the will specifically says it was made in anticipation of the marriage to a named person and is not effective until marriage takes place,

  • they are a member of the Canadian Forces, or

  • they are a sailor and at sea.
