Tenant’s Termination

Fixed term

A tenant may terminate a tenancy at the end of a period of the tenancy or at the end of the term of a tenancy for a fixed term by giving notice of termination to the landlord.

For daily or weekly rentals, the landlord must give at least 28 days' notice, and the termination date must be the last day of a rental period.

  • For monthly rentals, the landlord must give at least 60 days' notice, and the termination date must be the last day of a rental period.

  • For yearly rentals, the landlord must give at least 60 days' notice, and the termination date must be the last day of the rental year.

  • For rentals with a fixed term, the landlord must give at least 60 days' notice before the end date specified in the rental agreement.

A tenant may terminate a fixed term or yearly term before the end of the term if

  • a tenant has made a demand for a proposed tenancy agreement tenancy agreement

  • either one of the following applies

    • at least 21 days have elapsed since the day the tenant made the demand and the landlord has not complied with the demand

    • the landlord has complied with the demand and the tenant has not entered into a proposed tenancy agreement provided to the tenant by the landlord

  • a tenant may give notice no later than 30 days after the day the landlord has provided the proposed tenancy agreement to the tenant

  • a notice to terminate a yearly tenancy or a tenancy for a fixed term shall be given at least 60 days before the date the termination is specified to be effective and that date shall be on the last day of the rental period of the tenancy

Termination by the tenant for someone going through abuse or child abuse:

a tenant may terminate a monthly or yearly tenancy or a fixed-term tenancy by giving notice of termination to the landlord if the tenant or a child living with the tenant has experienced violence or abuse.

The notice must be given at least 28 days before the termination date and must be accompanied by a copy of an order related to the violence or abuse or a statement related to it.

Joint tenants may also terminate the tenancy, either jointly or individually by giving notice of termination of their interest in the tenancy.

The landlord cannot enter the unit to show it to prospective tenants until after the tenant or all the joint tenants have vacated the unit according to the notice.
