Overtime Pay
An employee is entitled to be paid at an overtime rate of wages equal to at least 1.5 times his or her regular rate for any work the employee performs that exceeds the standard hours of work in a day or a week.
Specific Industries
If there are any specific rules or regulations in place regarding standard hours of work and maximum hours of work in a particular industry or workplace, those rules will take precedence over the general rule set out.
Determining Overtime Rate
If the employee's pay is not based solely on the number of hours worked, the regular rate of pay for calculating overtime pay is determined based on the minimum wage rate set by law.
If an employee's pay is based on both time worked and other factors, the regular rate of pay for calculating overtime pay will be determined based on whichever rate is higher - either the hourly rate applicable to the time component of the wages or the minimum wage rate set by law.
If an employee works on a statutory holiday during a week in which they are entitled to a holiday with pay, the hours worked on the holiday do not count towards the calculation of overtime pay.
