Wrongful Dismissal

Wrongful termination occurs when an employer terminates an employee:

  • without the required notice or pay instead of notice; and

  • without just cause

If this occurs, an employee may be entitled to compensation.

Even if the reason for dismissal is valid, but without the proper notice provided is insufficient, dismissal can be considered "wrongful"

Just Cause

Refers to conduct that is of such a serious nature or extent that essentially breaks the employment relationship.
