Family Violence Leave
An employee who has been employed for the prescribed period of employment with an employer is entitled to family violence leave.
The employee is entitled to take leave for various reasons, including:
seeking medical attention,
obtaining services from a victim services organization,
obtaining psychological or
other professional counselling, relocating, seeking legal or law enforcement assistance, and other prescribed purposes.
The length of leave an employee is entitled to take is up to 10 days of paid leave and up to 15 weeks of unpaid leave each calendar year.
If an employee takes a paid day of leave, the employer must pay the employee either the wages the employee would have earned had they not taken the leave, or the daily wages of the employee based on the average of the employee’s daily wages for the four weeks immediately preceding the start of the paid family violence leave.
If the number of hours worked by the employee in a normal workday varies from day to day, or the employee’s wage for regular hours of work varies from day to day, the employee's daily wage is calculated based on the average of the daily wages earned by the employee in the four weeks before taking the leave.
