Equal Pay

Employers cannot pay employees of different genders or with different characteristics different rates of wages for the same job.

If there are legitimate reasons for paying employees different rates based on:

  • seniority,

  • merit,

  • quantity or quality of production, or

  • other factors unrelated to gender or other characteristics,

then it is allowed.

Employers must also post this section in a visible place in the workplace for all employees to see.

Employers cannot force employees to disclose their gender or characteristics, but they can use employee information to comply with this section.
