Termination by Employee

If an employee has worked for an employer for three months or more, they cannot quit their job without giving:

  • one week’s notice if the employee is less than 2 years; or

  • two weeks' written notice if the employment spanned less than 2 years

This rule does not apply to people working in construction.

If an employee gives notice, the employer cannot:

  • change the employee's wages or

  • employment conditions during the notice period, and

  • must pay the employee all the wages they are owed when the notice period is over.
