Compassionate Care Leave

If you have worked for an employer for at least three months and a doctor certifies that your family member has a serious medical condition and is at risk of dying within 26 weeks, you can take an unpaid leave of up to 28 weeks to provide care or support to them.

  • This leave can only be taken in periods of at least one week and must begin on the day the doctor's certificate is issued.

  • If you need to take leave after the initial 26 weeks, you don't need another certificate.

  • You must inform your employer as soon as possible about your intention to take leave and provide a copy of the certificate upon request.

  • If you stop providing care during a week of leave, your entitlement to leave continues until the end of the week and you can only return to work with your employer's agreement.
