Fixed term

When a tenant wants to move out of their rental home, they must give notice to the landlord. The amount of notice required depends on how often rent is paid and the length of the rental term.

  • If rent is paid weekly, the tenant must give the landlord at least 7 days' notice before the end of the week.

  • If rent is paid monthly, the tenant must give the landlord at least one month's notice before the end of the month.

  • If the rental term is for a fixed amount of time, such as a year, the tenant must give the landlord at least 2 months' notice before the end of the term.

Breach of agreement

if the landlord breaks an important part of the rental agreement, the tenant can tell the landlord in writing what the problem is. If the landlord doesn't fix the problem within a reasonable amount of time, the tenant can then give the landlord notice that they will be leaving the rental property.

Condition of premise

When the landlord does not keep the unit in a good state of repair in habitable conditions. If this is the case, the tenant can tell the landlord that they will be leaving the rental property right away.

The notice given by the person ending the agreement must be signed and state the date on which the rental agreement ends and when the tenant must vacate the property.

Peaceful enjoyment

If the landlord interferes with reasonable privacy and peaceful enjoyment of the premises, the tenant can give notice to end the rental agreement and move out within 5 to 14 days.

The notice must be written and signed by the tenant, and it needs to state the date when the rental agreement ends and when the tenant will move out.

Victims of family violence

If the tenant has received a certificate from the director stating that there are grounds to terminate the agreement due to a risk to the safety of the tenant or a child residing with the tenant as a result of family violence, they may terminate the agreement.

A tenant may terminate their rental agreement with at least 30 days' notice to the landlord.

The notice provided by the tenant must include a copy of the certificate issued by the director, and state the date on which the rental agreement will terminate.

The tenant is responsible for paying rent only until the end of the notice period, and the termination applies to all tenants under the same rental agreement. The landlord is required to notify other tenants that the rental agreement is being terminated.
