Agreement Requirements

The landlord must provide the tenant with a copy of the rental agreement, the Residential Tenancy Act, and any other regulations, and the tenant may need to sign an acknowledgment of receipt.

If the landlord doesn't provide the rental agreement or required information, the tenant can withhold rent until the landlord complies.

The rental agreement can be for a week-to-week, month-to-month, or fixed term of at least 6 months.

If the tenant continues to use the premises after a fixed-term agreement ends and notice hasn't been given, the tenancy can continue under the same terms until notice is given.

A landlord and tenant relationship begins when the tenant is entitled to use or occupy the premises, regardless of whether they actually do.

The rules of frustration of contract and the effect of contravening a material covenant apply to rental agreements.

Covenants concerning things related to the premises are considered to run with the land, even if they don't exist at the start of the tenancy.
