Overtime
Employers are required to pay 1.5 times the wages of the employee for every hour of work over 40 hours per week.
Time off instead
Employers may also compensate employees for overtime by giving them paid time off work instead of overtime pay, but only if both parties agree and the time off is taken within a certain timeframe.
Overtime pay upon termination
If the employment of an employee ends before the paid time off is taken, the employer must pay overtime pay for the overtime hours worked.
The regulations may also exempt certain employees or classes of employees from the law or vary the rest period.
Overtime Agreement
Additionally, if an employee agrees with one or more other employees to a change in their work schedule that results in working more than the standard working hours, and the employer grants the change, the employer is not required to pay overtime wages.
