Family Violence Leave

An employee who has worked for the same employer for 30 days or more is entitled to:

  • 3 days of paid leave; and

  • 7 days of unpaid leave in a year

if they, or someone they are responsible for, has been impacted by family violence.

The law defines family violence as violence committed by a family member, an intimate partner, a caregiver, or any other person specified in the regulations.

The employee can take this leave for reasons such as:

  • seeking medical attention,

  • counselling, or

  • legal services related to family violence.

The employee must provide reasonable verification to the employer, and unused leave expires at the end of the year.

The employer cannot dismiss or give notice of dismissal to an employee for taking this leave, and the employer must reinstate the employee at the end of the leave under the same terms and conditions as before the leave started.
