Crime-Related Death of Disappearance of a Child Leave

An employee who has worked for the same employer for at least 30 days can take up to:

  • 104 weeks of leave without pay if their child has died due to a crime, or

  • up to 52 weeks of leave without pay if their child has disappeared due to a crime.

The employee must provide reasonable verification of the necessity of the leave to the employer, and the leave must be limited to what is reasonably necessary.

The employee must give at least 2 weeks' written notice to the employer before taking the leave, and the employer cannot dismiss the employee because of their intention to take or take the leave.

The employer must reinstate the employee at the end of the leave on terms and conditions not less beneficial than before, and the leave does not count towards the employee's rights, benefits, and privileges under the law.

The Lieutenant-Governor in Council can make regulations regarding the terms and conditions of the leave, time frames for accessing it, and early termination of the leave.
