Bereavement and Sick Leave

Bereavement leave

Employees who have been working for their employer for at least 30 days are entitled to a certain amount of paid and unpaid leave in the event of the death of a family member.

If the family member is a spouse, child, grandchild, parent, sibling, grandparent, or in-law, the employee is entitled to one day of paid leave and two days of unpaid leave. If the family member is someone else, the employee is entitled to two days of unpaid leave. '

The employee's pay for the paid day of bereavement leave is calculated based on their hourly rate of pay and the average number of hours they worked in a day over the three weeks prior to the leave.

Sick/Family responsibility leave

The law also requires employers to provide unpaid sick leave or family responsibility leave to employees who have been working for at least 30 days.

Employees are entitled to seven days of unpaid leave per year for either sick leave or family responsibility leave.

If an employee takes three or more consecutive days of sick leave, they must provide their employer with a medical certificate. If they take three or more consecutive days of family responsibility leave, they must provide their employer with a written statement explaining the nature of the responsibility.

Note: Unused leave expires at the end of the year in which it was granted.
