Process of Filing for Divorce

The general process for filing for divorce includes:

  1. One party shall prepare and file an Application for divorce at the Supreme Court of Newfoundland and Labrador. This will set out the grounds for divorce and any other claims related to child custody, support, and property division

  2. The applicant must serve the other party the documents filed. Please note that the documents must be served by a third party.

  3. File an Affidavit of Service with the Court as soon as possible after the documents have been served.

  4. After the waiting period for a response of the other party, the applicant can request a divorce judgment from the court. The judge will review the application and supporting documents, and if they are satisfied all of the requirements have been met, the judge will issue the Divorce Judgement, granting the divorce.

  5. Once the judgement is granted, the applicant can apply for a certificate of divorce.
