Tenant Remedies

If a landlord fails to meet their obligations, the tenant can serve the landlord with a written notice outlining the complaint.

If the landlord still fails to comply within the specified time, the tenant can inform a residential tenancies officer.

The officer can then inspect the property and require the landlord to comply with their obligations.

If the landlord still fails to comply, the officer can perform the obligations and charge the landlord for the cost.

The officer can also require the tenant to make rental payments to them, pay for the cost of the obligations, and forward the balance to the landlord.

The tenant can also apply to terminate the tenancy and the officer can issue a notice of termination if the landlord is unwilling or unable to comply with their obligations.

If the tenancy is terminated, the landlord may have to compensate the tenant for expenses incurred and for rent paid during uninhabitable periods.
