Vacation Pay
Employers must give employees who have worked for less than 8 years a minimum of 2 weeks of vacation time per year, or 1 day for every month worked during the vacation pay year, whichever is less.
Employees who have worked for 8 years or more are entitled to a minimum of:
3 weeks of vacation time per year, or
1.25 days for every month worked during the vacation pay year, whichever is less.
Employers must provide at least one week's notice of when the vacation will start and pay employees either 4% or 6% of their wages for the vacation pay year, depending on their length of service.
If an employee's employment ends before the end of the vacation pay year, the employer must pay the employee either:
4% of the employee’s wages for vacation pay if the employee has been employed for less than 8 years; or
6% of their wages for the vacation pay year if the employee has been employed for more than 8 years
If other vacation provisions established by an agreement or contract are more favourable to the employee than the requirements of the Employment Standards Act, those provisions prevail.
