Notice/Pay in Lieu of Notice of Termination
Notice
If the employee has been employed for less than six months, the employer does not have to give notice.
If the employee has been employed for six months or more but less than five years, the employer must give two weeks' notice.
If the employee has been employed for five years or more, the employer must give four weeks' notice.
Pay in Lieu
An employer may not provide notice if they pay the employee the wages equivalent to the notice period that they would have been required to provide the employee.
No Notice/Pay Required
An employer may not be required to provide notice if:
there is a lack of work due to unforeseen circumstances;
the employee refuses reasonable work;
there is just cause for the termination;
the employee retires under a bona fide retirement plan.
