Notice of rent increase

If a landlord wants to increase the rent for a rental unit, they must give the tenant a written notice of the increase at least three months before the effective date of the increase.

If the landlord wants to remove or reduce a rent discount, they must also give the tenant a written notice at least three months before the effective date of the change.

This notice requirement does not apply if the rent increase is intended to take effect when a new tenant first moves in, or if the rent discount is being removed or reduced due to the tenant's breach of a condition of the discount.

The landlord must also give a copy of the notice to the director within 14 days of giving it to the tenant, except in certain exceptions such as subsidized housing or hotel accommodations. If the landlord does not give the required notice, any increase in rent is void.

Provisions of rent increases

Landlords cannot charge more than what is allowed by the law, and they can only increase the rent once a year, and not more than once in any 12-month period.

There are some exceptions to this rule, such as:

  • when the landlord regains possession of the rental unit or

  • if the tenant requests improvements or services.

If the landlord wants to increase the rent, they must give the tenant 3 months' notice, and the increase must be equal in each rental payment period.

In some cases, the director may be involved in the process, and affected parties may have the opportunity to examine the materials and file written comments.

There is currently a rent freeze in effect for 2022 and 2023.
