Vacation

An employee is entitled to at least two weeks of annual vacation after each of the first four years of employment, and at least three weeks of annual vacation after five consecutive years of employment and each year of employment after that.

The employer must provide the employee with an annual vacation not later than 10 months after the employee becomes entitled to it.

If the employer and employee cannot agree on when the vacation will take place, the employer must give the employee at least 15 days' notice of the vacation start date.

The employer cannot require an employee to take less than one week of vacation at a time, except if the business shuts down for an extended period, the employer may require the employees to take their annual vacations during that period.

An employer must pay an employee vacation allowance for each week of vacation, consisting of:

  • 2% of the wages earned in the year of employment and

  • 2% of the cash value of board and lodging.

The vacation allowance must be paid to the employee before their vacation begins.

If an employer gives a bonus or other pecuniary benefit to an employee, it does not affect the employee's entitlement to an annual vacation or vacation allowance.

The employer may establish a common anniversary date for calculating annual vacations and vacation allowances.

When an employee gives notice of termination, the employee's annual vacation cannot be used to calculate the required notice period, and the payment of a vacation allowance does not affect any other amount payable to the employee in respect of the termination.
