Death or Disappearance of a Child Leave

If an employee is a parent and their child has died or disappeared due to a probable crime, they may be entitled to an unpaid leave of absence from work.

  • If the child has died, the leave can be up to 104 weeks, and

  • if the child has disappeared, the leave can be up to 52 weeks.

An employee cannot take leave if they are charged with the crime.

The employee must give their employer notice of the leave and provide reasonable verification of the need for the leave.

The employee may end the leave early with written notice to the employer.
