Averaging Hours Agreement

An employee and employer may agree to average the employee’s hours worked over a period of 1-4 weeks for the purpose of determining the employee's entitlement.

This agreement:

  • must be in writing,

  • signed by the employee and employer before the start date provided in the agreement,

  • specify the number of weeks over which the agreement applies,

  • specifies the number of times, if any, the agreement may be repeated, and

  • provide a start and expiry date

This agreement must not equate to more than:

  • 40 hours, if the agreement specifies a 1-week period, or

  • an average of 40 hours per week if the agreement specifies more than 1 period

An employer who requires a 12-hour shift must pay double for any time over 12 hours a day at any time over the agreement

An employer who requires 40 hours a week must pay the employees 1.5 times for any hours over 40 hours

For the purpose of calculating weekly averages, only the first 12 hours of a day are counted, no matter how long the employee works

Over the term of the agreement, (1-4 weeks) the employee must average 32 hours consecutive hours, whether in the same week or different weeks or pa time and a half for any over

An employee is able to request an adjustment during the term of an agreement in a written request
