Notice for Termination/Pay in Lieu of Notice

After 3 consecutive months of employment, the employer becomes liable to pay an employee an amount equal to one week's wages as compensation for length of service.

  • after 12 consecutive months of employment, to 2 weeks’ wages

after 3 consecutive years of employment, an amount equal to 3 weeks’ wages and one additional week’s wages for every year of employment up to 8 weeks’ wages

Given written notice of termination with:

  • notice of one week after 3 consecutive months of employment

  • 2 weeks for 12 consecutive months of employment

  • 3 weeks after 3 consecutive years of employment plus one for every additional year up to 8 weeks’ notice

An employer can also:

  • give a combination of written notice in addition to money equivalent of the remainder of what the employer is liable for

  • terminate employment, retires from employment or is dismissed for just cause

Just Cause: a breach in the fundamental contract of employment or committed misconduct that is irreparably damaged the employment relationship
