Jury Duty Leave
If an employee is required to attend court as a juror:
the employer is not permitted to terminate the employment
or change the condition of employment without the employee’s written consent
Employment deemed continuous, which includes:
calculating annual vacation entitlement
any pension, medical or other plans beneficial to the employee
employer must continue making payments to a pension, medical, or other plans as though the employee was not on leave or attending court as a juror if:
the employer pays the total cost of the plan
if both the employer and the employee choose to continue to pay his or her share of the cost
the employee is entitled to any wage increase that they would have received if it were not for jury duty
none of this applies if the employee takes more time off than the leave warrants without the consent of the employer
