Jury Duty Leave

If an employee is required to attend court as a juror:

  • the employer is not permitted to terminate the employment

  • or change the condition of employment without the employee’s written consent

Employment deemed continuous, which includes:

  • calculating annual vacation entitlement

  • any pension, medical or other plans beneficial to the employee

  • employer must continue making payments to a pension, medical, or other plans as though the employee was not on leave or attending court as a juror if:

    • the employer pays the total cost of the plan

    • if both the employer and the employee choose to continue to pay his or her share of the cost

    • the employee is entitled to any wage increase that they would have received if it were not for jury duty

  • none of this applies if the employee takes more time off than the leave warrants without the consent of the employer
