To create a valid will, the following requirements must be fulfilled:

• The will must be written down.

• The testator (person making the will) must sign the document and make it clear that they intended to create a will.

• The will must follow one of three formats:

  • formal (signed by the testator in the presence of two witnesses),

  • holograph (entirely in the testator's own handwriting and signed by them), or

  • military (signed by a member of the Canadian Forces or other military services without any witnesses or formalities).
