Tenant Remedies

If a landlord commits a breach of a residential tenancy agreement, the tenant may apply to the court for one or more of the following remedies:

  • recovery of damages resulting from the breach or contravention;

  • abatement of rent to the extent that the breach deprives the tenant of the benefit of the residential tenancy agreement;

  • compensation for the cost of performing the landlord's obligations

  • termination of the tenancy by reason of the breach if in the opinion of the court that the breach is of such significance that the tenancy should be terminated
