Termination by Landlord
Weekly termination:
A notice to terminate a weekly tenancy given by a landlord or tenant must be served on or before the start of the week in which it will come into effect at the end of the week
Monthly termination:
A notice of termination by the landlord must be served on or before the first day of a notice period to be effective on the last day of that tenancy month
Yearly termination:
termination by the landlord on or before the 90th day before the last day of a tenancy year
Termination for substantial breach by the tenant
If a tenant breaks the terms of their rental agreement, the landlord can ask a court to end the tenancy or give the tenant a written notice at least 14 days before the tenancy ends.
The notice must be signed by the landlord or their agent, explain why the tenancy is being ended, specify the date the tenancy will end, and include any unpaid rent.
If the reason for ending the tenancy is unpaid rent, the notice must also say that the tenant can stop the tenancy from ending by paying all the rent owed by a certain date.
If the tenant pays all the rent owed or objects to the termination in writing before the termination date, the notice is no longer effective.
Requirements of termination:
A notice to terminate must:
be in writing
be signed by the person giving the notice or the person's agent,
the reasons for termination of tenancy
identify the premises that the notice is served
state the date on which the tenancy is to terminate
