Remedies for Landlord

If a tenant commits a breach of a residential tenancy agreement, the landlord may apply to a court for one or more of the following remedies:

  • where the breach consists of a non-payment of rent, recovery of arrears of rent;

  • where the breach consists of failing to give up possession of the residential premises,

    • recovery of possession from the overholding tenant, and

    • recovery of compensation for the use and occupation of the premises by the overholding tenant

  • where the breach is substantial, termination of the tenancy;

  • recovery of damages resulting from the breach
