Overtime Pay

  • An employer must pay an employee overtime pay overtime hours at a rate of at least 1.5 times the employee's wage rate:

    • this does not apply if the employer and employee have entered into an overtime agreement

    If there is an overtime agreement in place, the employer and employee may agree to:

    • substitute time off with pay instead of overtime pay (pay a normal wage rate

    • if time off without pay is not provided, the employee will be paid an overtime rate of 1.5 times the employee’s normal wage

    • no amendment or termination of an agreement is effective without at least one month's written notice
